College Hockey Spotlight Policies

Refund Policy

College Hockey Spotlight DOES NOT issue refunds. It is expected that if you have registered for College Hockey Spotlight, and have paid all applicable registration fees, you are able to attend. If you cannot attend College Hockey Spotlight in the year of your registration for any reason, and have paid all applicable registration fees, a CREDIT will be offered and must be used toward registration, and all applicable fees of the next College Hockey Spotlight event. Credits that remain unsued will become invalid as soon as the next College Hockey Spotlight event occurs. This credit arrangement assumes that you are eligible by age to attend College Hockey Spotlight. Exceptions to this policy will not be made for any reason, including weather, personal emergencies or circumstances, municipal/government policies or otherwise. Should a scenario arrise whereby we have previously agreed to refund all or a portion of your registration fee(s), we will do so net of any fees and expenses we will incur to process your refund.

COVID/Health Protocols

College Hockey Spotlight events will abide by the COVID-19/Health authortity rules and regulations set by the relevant authorities within the jurisdiction of the event each year.

Privacy Policy

Please read our Privacy Policy carefully so that you can understand how we collect, use, and disclose the personal information that you provide to us By accessing our website, you accept all the terms and conditions of this Privacy Policy. By submitting your personal data to us, you will be deemed to have given your permission for use and disclosures referred to herein.

College Hockey Spotlight does not intentionally collect personal data of persons under 18 years old. If you are under 18 years old and you wish to ask a question or use our website in anyway which requires you to submit your personal information, please have your parent or guardian do so on your behalf.

  • respond to queries or requests submitted by you

  • process orders or applications submitted by you

  • administer or otherwise carry out our obligations in relation to any agreement you have

  • with us

  • anticipate and resolve problems with any products or services supplied to you

  • better tailor and improve the features of products and services

  • create products or services that may meet your needs.

As part of the products or services offered to you through our website, the information you provide to us may be transferred to countries outside of Canada. By way of example, this may happen if any of our servers are from time to time located in a country outside of Canada or one of our service providers is in a country outside of Canada. These countries may not have similar data protection laws to Canada. In addition, if you use our services while you are outside Canada, your information may be transferred outside Canada to provide you with those services.

We may use third parties for the fulfilment of our obligations hereunder. However, except as set out in this Privacy Policy, we will not disclose any personally identifiable information without your permission unless we are legally entitled or required to do so (for example, if required to do so by legal process or for the purposes of prevention of fraud or other crime) or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users/customers etc. In the event our company, or part thereof, is acquired by another company, that company may use your personal data in accordance with this Privacy Policy.

Providing you with additional information and sharing your information From time to time, we would like to use your personal information for purposes other than as set out in the above section. We believe that these additional uses will be of benefit to you. However, we understand that you may not wish us to use your information in this way.

In such case we will, however, continue to use your personal data for the purposes set out in the above section for as long as necessary to achieve such purposes.

  • giving the information any of our affiliate offices and companies, which may be locatedoutside Canada, to enable them to send you information which may be of interest to you.

You cannot be identified from this information, and it is only used to assist us in providing an effective service on our website.

ASSUMPTION OF RISK, WAIVER, INDEMNITY AND RELEASE FROM LIABILITY AGREEMENT

In consideration of Player’s participation in College Hockey Spotlight practices, games, activities, training, programs and/or on-ice instruction (“the Activities”), the Player and Guardian agree to all the terms and conditions set forth in this agreement (“the Agreement”).

ASSUMPTION OF RISKS

Player and Guardian freely and fully acknowledge and understand all risks relating to ice hockey and the Activities, and understand that ice hockey and the Activities involve foreseeable and unforeseeable inherent risks, hazards and dangers to Player’s person including bodily injury, partial or total disability, paralysis and death, and damages including property damage, that no amount of care, caution or expertise can eliminate, which may arise therefrom. These risks and dangers may be caused by the negligence of the Player or the negligence of others, including College Hockey Spotlight.

PLAYER AND GUARDIAN FREELY ACCEPT AND FULLY ASSUME ANY AND ALL RISKS, DANGERS AND HAZARDS INVOLVED AND THE POSSIBILITY OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF COLLEGE HOCKEY SPOTLIGHT OR OTHERWISE.

Player and Guardian acknowledge, understand and assume all risks, if any, arising from the conditions and use of ice hockey rinks and related premises, acknowledge and understand that included within the scope of this assumption of risk, waiver and release is any cause of action, arising from the performance, or failure to perform maintenance, inspection, supervision or control of said areas and for the failure to warn of dangerous conditions existing at said rinks, for negligent selection of certain locations for instruction, or negligent supervision of instruction by College Hockey Spotlight.

RELEASE FROM LIABILITY

Player and Guardian hereby expressly waive and release any and all claims which Player and/or Guardian have or may in the future have against College Hockey Spotlight, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors, and assigns (collectively, "Releasees"), on account of injury, death, or property damage arising out of or attributable to Player’s participation in the Activities, due to any cause whatsoever, including without limitation the negligence of College Hockey Spotlight or any other Releasee, breach of contract, or breach of any statutory or other duty of care owing under occupiers liability legislation or otherwise. Player and Guardian agree not to make or bring any such claim against College Hockey Spotlight or any other Releasee, and forever release and discharge College Hockey Spotlight and all other Releasees from liability under such claims.

INDEMNIFICATION PLAYER AND/OR GUARDIAN SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS COLLEGE HOCKEY SPOTLIGHT AND ALL OTHER RELEASEES AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, LIABILITIES, DEFICIENCIES, ACTIONS, JUDGMENTS, SETTLEMENTS, INTEREST, AWARDS, PENALTIES, FINES, COSTS, OR EXPENSES OF WHATEVER KIND, INCLUDING REASONABLE LEGAL FEES, IN CONNECTION WITH ANY THIRD-PARTY CLAIM, SUIT, ACTION, OR PROCEEDING ARISING OUT OF OR RESULTING FROM THE ACTIVITIES.

This Agreement constitutes the entire agreement of College Hockey Spotlight and Player and/or Guardian with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.

This Agreement is intended to be as broad and inclusive as is permitted by law of the Province of Ontario. If any term or provision of this Agreement is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.

This Agreement is binding on and shall enure to the benefit of Player and/or Guardian and their heirs and next-of-kin, and College Hockey Spotlight and its successors and assigns.

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein and the parties attorn to the Courts of the Province of Ontario.

Electronic Signatures and Electronic Delivery. Electronic signatures included in this Agreement are intended to authenticate this writing and to have the same force and effect as manual signatures. Electronic signature means any electronic symbol or process attached to a record and executed and adopted by a party with the intent to sign such record. Delivery of an executed copy of this Agreement by email constitutes valid and effective delivery.

THE UNDERSIGNED PLAYER AND GUARDIAN HAVE READ AND UNDERSTAND THIS AGREEMENT AND REALIZE THAT BY SIGNING THIS AGREEMENT PLAYER AND GUARDIAN ARE SURRENDERING AND RELEASING SUBSTANTIAL LEGAL RIGHTS (ON THEIR BEHALF AND ON BEHALF OF THEIR HEIRS, EXECUTORS, ADMINISTRATORS AND NEXT OF KIN), INCLUDING THE RIGHT TO SUE COLLEGE HOCKEY SPOTLIGHT AND THE RELEASEES, AND DO SO FREELY AND VOLUNTARILY.
